These SMS Terms & Conditions (“Terms”) govern participation in SMS messaging programs facilitated by Acadia Digital Marketing (“Acadia,” “we,” “our,” or “us”) on behalf of participating merchants using our point-of-sale and marketing platforms.

By opting in to receive SMS messages, you agree to these Terms.

1. Program Description

Acadia Digital Marketing provides SMS messaging services that allow participating merchants to send promotional, informational, and transactional text messages to individuals who have explicitly opted in.

Message content may include, but is not limited to:

  • Promotions, discounts, and special offers
  • Appointment or order notifications
  • Account or service-related updates

2. Opt-In & Consent

You will receive SMS messages only if you have provided express consent.

Opt-in may occur through:

  • In-store sign-up
  • Online forms
  • Point-of-sale prompts
  • Other consent-based methods

Consent is not a condition of purchase.

3. Message Frequency

Message frequency varies depending on the merchant, campaign, and user interaction. Message volume may vary.

4. Message & Data Rates

Message and data rates may apply. Charges are billed by and payable to your mobile carrier and are not the responsibility of Acadia Digital Marketing.

5. Opt-Out Instructions

You may opt out of SMS messaging at any time by replying STOP. After opting out, you will no longer receive SMS messages unless you opt back in.

7. Supported Carriers

SMS messaging is supported by most major U.S. carriers. Carriers are not liable for delayed or undelivered messages.

8. Prohibited Use (SHAFT Compliance)

Acadia Digital Marketing strictly prohibits the use of its SMS services for content related to:

  • Sexually explicit material
  • Hate, harassment, or discriminatory content
  • Alcohol (unless legally permitted and carrier-approved)
  • Firearms, weapons, or explosives
  • Tobacco, vaping, nicotine products, or controlled substances
  • Illegal, deceptive, or misleading activities

Participating merchants are required to comply with all applicable laws and carrier policies.

9. Privacy

Your privacy is important to us.

No mobile information will be shared or sold to third parties or affiliates for marketing or promotional purposes.

10. Eligibility

SMS programs are intended for individuals 18 years of age or older.

11. Changes to Terms
